1. GENERAL

1.1 The use of personal data by Planet Yoga AG Gesellschaft (CHE112005915), based in Zurich and with the business address Eichstrasse 23, 8045 Zurich ("Planet Yoga"), is based on the applicable legal provisions and the consent to use given by the user his data.

1.2 Planet Yoga operates a studio for yoga/meditation/workshops. Various services in the field of sports and leisure activities and products (collectively the "sports offer") can be booked, reserved or purchased via Planet Yoga. The sports offers are provided by Planet Yoga in-house. The subject of the contract is the use of the services of Planet Yoga (the "Service"). The use of the services of Planet Yoga is carried out by users (the "Users").

1.3 Planet Yoga is aware that the protection and careful handling of the user's personal data is very important. Since data protection is very important to Planet Yoga, Planet Yoga strictly adheres to the legal provisions applicable in Switzerland (GDPR, Telecommunications Act (TKG/TMG)) when using this data.

 

1.4 The user is required to visit Planet Yoga's General Terms and Conditions (GTC) regarding the subject matter of the contract, the user's obligations, limitations of liability and numerous other important information on the Planet Yoga website under the domain (www.planetyoga.ch).

 

2. COLLECTION OF DATA

2.1 Planet Yoga collects and stores any information that the user provides on the Eversports platform ("Eversports") and that is transmitted to Planet Yoga in the course of an online booking or that the user makes available to Planet Yoga in any other way, for example on site . Planet Yoga uses the user's personal data to the extent permitted by law and otherwise only with the user's consent. Insofar as consent is given electronically within the framework of an online booking via Eversports, Eversports takes into account the legal information requirements and logs this consent using suitable technical systems.

2.2 Planet Yoga uses the following personal data of the user: name, e-mail address, telephone number, gender, date of birth, profile pictures, place of residence, booking data, existing products,...

3. PURPOSE OF DATA USE

3.1 We process your data as part of the fulfillment of the contract for the following purposes:

• To make reservations and store open products.

• To create invoices.

• To create a booking history.

• Information mail about the studio program

You can object to this data processing. A revocation means that we will no longer process your data for the above-mentioned purposes from this point in time. It should be noted that Planet Yoga services can no longer be used in the event of revocation and the Studio Planet Yoga profile must be deleted. 3.2 If you have subscribed to our newsletter, we will process your data to send our newsletter. You can cancel your subscription to the newsletter at any time directly via a link in the newsletter e-mails or by sending an e-mail to: office@planetyoga.ch.

3.3 We store your data for the duration of the contractual relationship. By default, Studio Planet Yoga profiles, including the profile data provided by the user, are deleted 3 years after the last booking in the event of inactivity and without a valid product (e.g. block of 10, subscription, etc.). Data that is on an invoice or is necessary for invoicing is stored longer due to the statutory retention period. After the retention period has expired, this data will also be deleted.

4. DATA SECURITY

4.1 For reasons of data security, personal data is stored in a closed system (Eversports) and protected with a password.

4.2 Eversports is Planet Yoga's data processor and has taken appropriate measures to ensure data security (see: https://www.eversports.at/h/security).

4.3 If Planet Yoga becomes aware that the user's data has been used systematically and seriously unlawfully and the user is threatened with damage, Planet Yoga will inform the user immediately.

4.4 The Planet Yoga website contains links to other services or websites. Planet Yoga is not responsible for the privacy policies and/or practices of other websites. If the user follows the link to another website, the user is solely responsible for familiarizing himself with the privacy policy of that other website. Planet Yoga's privacy policy is limited only to information processed by Planet Yoga.

4.5 Planet Yoga uses other processors in addition to Eversports for this data processing. We pass on your data to the following additional recipients or categories of recipients:

• Software provider for processing bookings, managing products, cash register, ...

• Communication tools for customer communication

• External hosting providers for data storage

Your data will be processed within the EU or the EEA // at least some of it will also be processed outside the EU or the EEA, namely in xxx and xxx. The appropriate level of protection results from an adequacy decision by the European Commission in accordance with Article 45 GDPR.

5. USE OF COOKIES

In order to make visiting our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your end device. Some of the cookies we use are deleted after the end of the browser session, i.e. after closing your browser (so-called session cookies). Other cookies remain on your end device and enable us or our partner companies to recognize your browser on your next visit (persistent cookies). 6. DECLARATION OF CONSENT TO THE PRIVACY POLICY

By ticking the box during an online booking with Eversports, the user confirms that he has read Planet Yoga's data protection regulations. In the case of an on-site booking, the user confirms by signing the data protection regulations on site that he has read the data protection regulations of Planet Yoga.
